COMMERCIAL (B2B) VS. CONSUMER (B2C) CUSTOMER STATUS
Our store serves both commercial trade businesses and private consumers. The legal terms governing your order depend strictly on your purchasing status at checkout:
Commercial / Business Customers (B2B): If you are purchasing equipment or items for use in a business, trade, commercial kitchen, restaurant, takeaway, cafe, school, charity, landlord capacity, or institutional environment, you are classified as a Business Customer. You explicitly agree that UK Consumer Contracts Regulations (cooling-off periods) do not apply to your order. All trade sales are final.
Consumer Customers (B2C): If you are a private individual purchasing items strictly for personal, domestic, and household use, you are classified as a Consumer and retain all your mandatory statutory protections under the UK Consumer Rights Act. Nothing within these Terms of Service affects any statutory rights available to consumers under applicable UK consumer protection legislation.
PRICING, TAXES, AND VAT
All base prices displayed on our website are shown exclusive of Value Added Tax (VAT) unless explicitly stated otherwise.
For maximum transparency for both our trade and consumer clients, we display the clear breakdown of the base price (+VAT) and the total inclusive price directly on our product pages. VAT is calculated firmly at checkout at the prevailing UK standard rate and is the sole responsibility of the buyer.
We reserve the right to adjust prices at any time without prior notice due to fluctuating supplier logistics costs or manufacturer adjustments. In the rare event an item is listed at an incorrect price due to a system error, we reserve the right to cancel the order and issue a full refund before dispatch.
COMMERCIAL EQUIPMENT INSTALLATION AND SAFETY
This clause is a strict condition of sale for all commercial trade buyers purchasing heavy machinery, refrigeration, or utility-connected appliances:
Professional Installation Required: All heavy-duty commercial catering equipment, extraction systems, commercial refrigeration units, and hardwired electrical or gas appliances must be installed, commissioned, and structurally tested by a fully certified, industry-recognized professional engineer (e.g., Gas Safe registered for gas appliances, or NICEIC certified for electrical installations).
Proof of Installation: In the event of a technical breakdown or manufacturer warranty claim, the business buyer must provide an official, dated installation certificate or service report from a certified engineer. Failure or refusal to provide valid engineering documentation where professional installation is required may result in the rejection of warranty claims relating to installation, commissioning, or operational faults. My Globel LTD accepts no liability for equipment failure, property damage, or personal injury due to improper, amateur, or self-installation.
LIMITATION OF LIABILITY AND CONSEQUENTIAL LOSSES
This section strictly limits what My Globel LTD can be held financially responsible for in a commercial business setting:
Nothing in these Terms of Service shall exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability which cannot be excluded or limited under applicable law.
No Liability for Business Interruption: My Globel LTD shall not under any circumstances be held liable to business customers or commercial entities for any indirect, incidental, special, or consequential losses. This includes, but is not limited to: loss of business profits, loss of business revenue, operational downtime, staff wages, reputation loss, or the spoilage/loss of food and stock due to equipment failure, technical breakdown, or carrier delivery freight delays.
Maximum Liability Cap: Our absolute maximum financial liability to any business buyer for any claim arising from an order or service dispute shall not exceed the net price paid by the customer for the specific item causing the issue.
DELIVERY, KERBSIDE TRANSIT, AND TRANSFER OF RISK
Delivery Scope: Heavy commercial kitchen equipment, extraction hoods, and large refrigeration units are delivered via heavy freight transport vehicles and are restricted to kerbside or business threshold delivery only. Offloading drivers are not insured to move heavy machinery inside your premises, unpack boxes, or navigate stairs.
Access Requirements: The buyer must ensure the delivery site has adequate, clear physical access for large delivery vehicles/lorries. If a delivery fails because the business is closed during operating hours, or because a large vehicle cannot physically access the premises safely, the buyer will be charged a standard corporate redelivery fee.
Transfer of Risk: Risk of physical damage or loss of the goods passes entirely to the buyer immediately upon delivery and the signing of the carrier's transit note.
GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of England and Wales. Any legal disputes arising from transactions on this website shall be handled exclusively in the courts of England and Wales.
